This Privacy Policy describes how Artist Growth collects, uses, and discloses information through the artistgrowth.com website (the “website”). If you have any questions, please don’t hesitate to contact us as explained in the “How to Contact Us” section below.

You can browse the website without telling us who you are or revealing any personal information about yourself other than the information that you automatically provide us (discussed below).

In order to take advantage of the services we provide through the website, you may place an order and/or create a login account. When you place an order through the website or create a login account, you will be asked to provide certain information about yourself, including but not limited to your name, address, phone numbers, email address, and similar information. This allows us to process and fulfill your order, to provide the services ordered, to facilitate future ordering, and to provide you with information regarding your ordering history. Additionally, when you sign up to receive newsletters and other updates, you will be asked to provide your email address. We will use this email address to send you the requested newsletters and updates.

In addition to information that you provide us, we automatically track certain information based upon your behavior on the website. We use data collection devices, such as “cookies,” on certain pages of the website to help analyze our website flow, website performance, and content structure, as well as to allow you to make purchases on our site through the “shopping cart” function and maintain a “login account.” Cookies are pieces of information that a website transfers to an individual’s computer for record-keeping purposes. These cookies will be placed as a text file in the browser of your computer. In some jurisdictions we are not permitted to use cookies without your expressed consent.  In this case, we will seek such consent.  The remainder of this section assumes that either the use of cookies is not restricted by applicable law, or if it is restricted that the individual has explicitly consented to the use of the cookies.  Other information that we may automatically collect includes computer type, browser-type and plug-ins, operating system, java script enables, and city and country. Additionally, we may automatically collect your Internet Protocol address (“IP address”). Your IP address is a unique numerical address consisting of four numbers separated by periods which provides the location to an individual computer on the Internet. IP addresses are used to designate the computer from which you are accessing the website.

We also obtain data about you when you interact with the website, such as when you look at a page, send a message through the website, search for users or content on the website, make purchases through the website, and click on an ad featured on or linked to the website. When you post certain content on the website, such as videos, photographs and sound files, we may receive metadata that tells us the time, date and/or location in which the file was created. We receive information from the computer or other device you use to access the website, which may include but is not limited to your IP address, location, browser type, operating system, and user ID. We may receive data from our advertisers, users, and other third parties that assists us and them in delivering advertisements or other information, understanding online activity, and improving the website and our services. Other websites may utilize an Artist Growth platform or feature. We may receive data, including but not limited to your IP address, browser type, operating system, and location, the identity of the website through which you are accessing the platform or feature, and information regarding your activity on that third party website, when you use these platforms and features.

You may also choose to participate in third party applications accessible via the website (for example, Facebook) through which you post content or allow us to collect (or the third party to share) information about you, including personal information. The third party may allow you to remove the application, in which case we will no longer collect information about you through that application, but we may retain the information previously collected. We may receive information about you if other users of third party applications give us access to their profiles and you are one of their “connections” or information about you is otherwise accessible through your “connections’” web page, profile page, or similar page on a social networking or other third party web sites or interactive service. If you choose to “like” content on our website or to otherwise post information from or via our website to third party applications, that information will become public, and the third parties may have access to information about you and your use of our website.

2. Our Use of Your Information

3. Release of Information

We don't sell, rent or otherwise share identifiable personal information about you to third parties for their marketing purposes without your explicit consent. However, under the circumstances described in this paragraph, we may release information about you to third parties. Your use of the website constitutes consent to our release of information solely as described in this Policy.

We may provide de-identified data about you to our advertisers, users, or other third parties. We may release information about you to legal authorities to comply with valid legal requirements such as a law, regulation, search warrant, subpoena or court order. Additionally, in response to a verified request by law enforcement or other government officials relating to a criminal investigation or other alleged illegal activities, we can (and you authorize us to) disclose information about you, including, without limitation, your name, city, state, telephone number, email address, IP address and User ID history, without a subpoena.

Due to the existing regulatory environment, we cannot ensure that any and/or all of your private communications and other personal information will never be disclosed in ways not described in this privacy policy. By way of example (without limiting the foregoing), third parties may unlawfully intercept or access transmissions or private communications. Therefore, although we take measures to protect your privacy, we do not promise, and you should not expect, that your personal information or private communications will always remain private.

4. Ownership of your Information

Your personal information is, and will remain, owned by you. By using the website, you grant to Artist Growth a perpetual, worldwide, royalty-free license to use your information and data about you solely in accordance with the terms of this privacy policy (as it now exists and may be amended in accordance with Section 8, below).

5. Storage and Protection of Your Information

By registering for an account and using the website, you consent to the transfer of your information to anywhere in the U.S. where we maintain facilities and servers and the use and disclosure of information about you as described in this Privacy Policy.  We will retain your information as long as it is necessary for the purpose for which we are using it or in accordance with legal obligations if such obligation is longer.

6. Payment Information

You may make payments using a third-party payment services provider, such as Braintree or Stripe, made available through the website. In connection with making payments, you may be required to provide additional information to facilitate the transaction, such as your bank account or credit card information. We do not store or use this payment information in any way other than to relay the information to the third-party payment services provider to facilitate the transfer of funds. After payment, we do not have access to your bank account or credit card information. The third-party payment services provider’s use of such information shall be governed by its applicable terms of services and/or privacy policy. We recommend that you review such terms and/or privacy policy should you have any questions about the third party’s practice.

7. Links to Websites Not Affiliated With Artist Growth

This privacy policy applies only to information collected by this website. This website contains links to other websites that are not owned or controlled by us. Please be aware that we are not responsible for the privacy practices of other websites. When you leave our site, please read the privacy policies of any website that may collect your personal information.

8. Information Security

We take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data. These may include appropriate encryption and physical security measures to guard against unauthorized access to systems where we store personal data.  Although we implement reasonable administrative, physical and electronic security measures designed to protect your information from unauthorized access, we cannot ensure the security of any information you transmit to or guarantee that this information will not be accessed, disclosed, altered, or destroyed. We will make any legally required disclosures of any breach of the security, confidentiality, or integrity of your unencrypted electronically stored Personal data. To the extent the law of your jurisdiction allows for notification of a breach via e-mail or conspicuous posting on the website you agree to accept notice in that form

9. Your rights about your personal information

a) For California Residents

California consumers have the right to request access to their personal data, additional details about our information practices and deletion of their personal data (subject to certain exceptions).  California consumers also have the right to opt out of sales of personal data, if applicable.   We describe how California consumers can exercise their rights under the CCPA.  Please note that you may designate an authorized agent to exercise these rights on your behalf by providing written materials demonstrating that you have granted the authorized agent power of attorney.  Please note that if an authorized agent submits a request on your behalf, we may need to contact you to verify your identity and protect the security of your personal data.  We will not fulfill your CCPA request unless you have provided sufficient information for us to reasonably verify you are the consumer about whom we collected personal data.  We will not discriminate against you if you choose to exercise your rights under the CCPA.

You may request, no more than twice in a 12-month period, access to the specific pieces of personal data we have collected about you in the last 12 months.  You may also request additional details about our information practices, including the categories of personal data we have collected about you, the sources of such collection, the categories of personal data we share for a legitimate business or commercial purposes, and the categories of third parties with whom we share your personal data. You may make these requests by contacting using the contact information provided below in the “How to Contact Us” section.   After submitting your request, please monitor your email for a verification email.  We are required by law to verify your identity prior to granting access to your data in order to protect your privacy and security.

You may request, no more than twice in a 12-month period, transportable copies of your personal data that we have collected  about you in the last 12 months.  You may make these requests by contacting using the contact information provided below in the  “How to Contact Us” section.  After submitting your request, please monitor your email for a verification email.  We are required by law to verify your identity prior to granting access to your data in order to protect your privacy and security.  

You may request that we delete the personal data we have collected about you.  Please note that we may retain certain information as required or permitted by applicable law.  You may make these requests by contacting us using the contact information provided below in the  “How to Contact Us” section.  After submitting your request, please monitor your email for a verification email.  We are required by law to verify your identity prior to granting access to your data in order to protect your privacy and security

b) For EU/EEA Residents

If you reside in the United Kingdom, EEA, or Switzerland, you may request that we take the following actions in relation to your personal data according to the GDPR: 

  • Access. Provide you with information about our processing of your personal data and give you access to your personal data 
  • Correct. Update or correct inaccuracies in your personal data 
  • Delete. Delete your personal data 
  • Transfer. Transfer a machine-readable copy of your personal data to you or a third party of your choice 
  • Restrict. Restrict the processing of your personal data 
  • Data portability. You have the right to request for the receipt or the transfer to another organization, in a machine-readable form, of your personal data 
  • Object. Object to our legitimate interests as the basis of our processing of your personal data 
  • Right to withdraw consent. When you have given your explicit consent for the processing of your data, you can withdraw it at any time without justification 
  • You also have the right to lodge a complaint with your local Data Protection Authority or to the Data Protection Authority where the alleged infringement took place

10. Your Choices about Your Information

In all promotional emails, you will be given the opportunity to opt-out of receiving such messages in the future by clicking on the link at the bottom of the email that says “unsubscribe.” Please note, we reserve the right to send you services-related communications (e.g., account verification, payment confirmations, technical and security notices) for which you may not opt out.

11. Updating and Correcting Your Personal Information

You can review and amend the information you have provided us by signing on to your login account.

12. Changes to this Privacy Policy

We may amend this privacy policy at any time by posting the amended terms on the website. Changes to the privacy policy will be notated by updates to the “Effective” date at the top of this page. Your continued use of the website after the posting of an amended privacy policy constitutes your acknowledgment and acceptance of those terms.
