This Privacy Policy describes how Artist Growth collects, uses, and discloses information through the artistgrowth.com website (the “Website”), our software platform and related services (the “Services”), and our mobile application (the “App”). This includes information that may be shared with third-party service providers, including AI providers, in connection with features that integrate external tools and services. If you have any questions, please don’t hesitate to contact us as explained in the “How to Contact Us” section below.

1. Information We Collect

You can browse the Website without telling us who you are or revealing any personal information about yourself other than the information that you automatically provide us (discussed below).

In order to take advantage of the Services we provide, you may place an order and/or create a login account. When you place an order through the Website or create a login account, you will be asked to provide certain information about yourself, including but not limited to your name, address, phone numbers, email address, and similar information. This allows us to process and fulfill your order, to provide the services ordered, to facilitate future ordering, and to provide you with information regarding your ordering history. Additionally, when you sign up to receive newsletters and other updates, you will be asked to provide your email address. We will use this email address to send you the requested newsletters and updates.

In addition to information that you provide us, we automatically track certain information based upon your behavior on the Website, Services, and App. We use data collection devices, such as “cookies,” on certain pages of the Website to help analyze our website flow, website performance, and content structure, as well as to allow you to make purchases on our site through the “shopping cart” function and maintain a “login account.” Cookies are pieces of information that a website transfers to an individual’s computer for record-keeping purposes. These cookies will be placed as a text file in the browser of your computer. In some jurisdictions we are not permitted to use cookies without your expressed consent. In this case, we will seek such consent. The remainder of this section assumes that either the use of cookies is not restricted by applicable law, or if it is restricted that the individual has explicitly consented to the use of the cookies. Other information that we may automatically collect includes computer type, browser-type and plug-ins, operating system, javascript enables, and city and country. Additionally, we may automatically collect your Internet Protocol address (“IP address”). Your IP address is a unique numerical address consisting of four numbers separated by periods which provides the location to an individual computer on the Internet. IP addresses are used to designate the computer from which you are accessing the Website, Services, or App.

We also obtain data about you when you interact with the Website, Services, and App, such as when you look at a page, send a message, search for users or content, make purchases, and click on an ad featured on or linked to the Website, Services, or App. When you post certain content, such as videos, photographs and sound files, we may receive metadata that tells us the time, date and/or location in which the file was created. We receive information from the computer or other device you use to access the Website, Services, or App, which may include but is not limited to your IP address, location, browser type, operating system, and user ID. We may receive data from our advertisers, users, and other third parties that assists us and them in delivering advertisements or other information, understanding online activity, and improving the Website, Services, and App. Other websites may utilize an Artist Growth platform or feature. We may receive data, including but not limited to your IP address, browser type, operating system, and location, the identity of the website through which you are accessing the platform or feature, and information regarding your activity on that third party website, when you use these platforms and features.

You may also choose to participate in third party applications accessible via the Website, Services, or App (for example, Facebook) through which you post content or allow us to collect (or the third party to share) information about you, including personal information. The third party may allow you to remove the application, in which case we will no longer collect information about you through that application, but we may retain the information previously collected. We may receive information about you if other users of third party applications give us access to their profiles and you are one of their “connections” or information about you is otherwise accessible through your “connections’” web page, profile page, or similar page on a social networking or other third party web sites or interactive service. If you choose to “like” content on our Website or to otherwise post information from or via our Website, Services, or App to third party applications, that information will become public, and the third parties may have access to information about you and your use of our Website, Services, and App.

In connection with your use of any AI-integrated features of the Services or App, including any third-party service provider (including any AI provider) you connect to the Services, we may also collect information about your use of those integrations, including the nature and timing of queries made to your data through such integrations. We do not control what information a third-party service provider collects or retains in connection with processing your queries, and we encourage you to review the privacy policy of any third-party service provider you connect to the Services or App.

2. Our Use of Your Information

We use the information collected through the Website, Services, and App in connection with our legitimate business purposes: (i) of providing our services to you and other Artist Growth users, (ii) in connection with third parties advertising to you through the Website, Services, and App, and (iii) to assist developers in creating applications and other programs that relate to our services. For example, we may use your information to facilitate our efforts to make the Website secure; to make suggestions to you about services or products that may be relevant to you; to provide you with new features and services; and to understand whether advertising you see has been effective.

We use the information you provide to provide you with our services, to contact you regarding other Artist Growth products or services, and to provide you with your account and purchase history from our site. We may use personal information about you (including the information we automatically collect from you) to market to you, to analyze website usage and promotional effectiveness, to improve our content, to perform trouble-shooting activities, and to customize the Website’s, Services’, and App’s content, layout, and services. These uses help us improve the Website, Services, and App and better tailor them to meet your needs, in order to provide you with a smooth, efficient, safe and customized experience. We may additionally use your personal information to send you administrative notices and communications relevant to your use of the Website, Services, and App (including regarding this privacy policy and the terms and conditions).

In connection with AI-integrated features of the Services or App, we may transmit your User Data and Your Content to third-party service providers (including any AI provider) solely for the purpose of fulfilling queries you initiate through those integrations. We do not use your User Data or Your Content to train, fine-tune, or develop any AI model (except as described in Section 8.05 of our Terms of Service with respect to de-identified data), and we do not sell your User Data or Your Content to AI providers. Whether your data is used by an AI provider for model training or other purposes beyond fulfilling your query is governed by your organization’s settings with that AI provider and their applicable terms of service and privacy policy — not by AG. We encourage you to review those settings and policies before enabling any AI integration.

We may use data and information about you that has been “de-identified” (data from which your name or any personally identifying information has been removed, or the data has been combined with other people’s data in such a way that it is no longer associated with you) for any purpose. This applies solely to data processed within AG’s own systems; we do not control how third-party service providers handle de-identified data. When we receive data about you from advertisers or other third parties, we will retain such data in identifiable form for no more than six (6) months. After that period, we will retain the data only in de-identified form.

3. Release of Information

We don’t sell, rent or otherwise share identifiable personal information about you to third parties for their marketing purposes without your explicit consent. However, under the circumstances described in this paragraph, we may release information about you to third parties. Your use of the Website, Services, and App constitutes consent to our release of information solely as described in this Policy.

We may also transmit your User Data and Your Content to third-party service providers (including any AI provider) where you have enabled an integration, solely to fulfill your requested queries. Such transmissions are made at your direction and do not constitute a sale or rental of your data.

We may provide de-identified data about you to our advertisers, users, or other third parties. We may release information about you to legal authorities to comply with valid legal requirements such as a law, regulation, search warrant, subpoena or court order. Additionally, in response to a verified request by law enforcement or other government officials relating to a criminal investigation or other alleged illegal activities, we can (and you authorize us to) disclose information about you, including, without limitation, your name, city, state, telephone number, email address, IP address and User ID history, without a subpoena.

Due to the existing regulatory environment, we cannot ensure that any and/or all of your private communications and other personal information will never be disclosed in ways not described in this privacy policy. By way of example (without limiting the foregoing), third parties may unlawfully intercept or access transmissions or private communications. Therefore, although we take measures to protect your privacy, we do not promise, and you should not expect, that your personal information or private communications will always remain private.

4. Ownership of Your Information

Your personal information is, and will remain, owned by you. By using the Website, Services, and App, you grant to Artist Growth a perpetual, worldwide, royalty-free license to use your information and data about you solely in accordance with the terms of this privacy policy (as it now exists and may be amended in accordance with Section 12, below). Your ownership of your personal information extends solely to data held within AG’s systems. AG cannot enforce or guarantee your ownership rights with respect to data transmitted to a third-party service provider (including any AI provider) through an integration, and any such rights are governed solely by your agreement with that provider.

5. Storage and Protection of Your Information

By registering for an account and using the Website, Services, and App, you consent to the transfer of your information to anywhere in the U.S. where we maintain facilities and servers and the use and disclosure of information about you as described in this Privacy Policy. We will retain your information as long as it is necessary for the purpose for which we are using it or in accordance with legal obligations if such obligation is longer. AG’s storage and retention commitments under this section apply solely to data held within AG’s own systems. Data transmitted to a third-party service provider (including any AI provider) through an integration is stored and retained according to that provider’s own policies, over which AG has no control. We encourage you to review the storage and retention policies of any third-party service provider you connect to the Services or App before enabling an integration.

6. Payment Information

You may make payments using a third-party payment services provider, such as Stripe or other payment processors made available through the Website, Services, or App. In connection with making payments, you may be required to provide additional information to facilitate the transaction, such as your bank account or credit card information. We do not store or use this payment information in any way other than to relay the information to the third-party payment services provider to facilitate the transfer of funds. After payment, we do not have access to your bank account or credit card information. The third-party payment services provider’s use of such information shall be governed by its applicable terms of services and/or privacy policy. We recommend that you review such terms and/or privacy policy should you have any questions about the third party’s practice.

7. Links to Third-Party Websites and Services Not Affiliated With Artist Growth

This Privacy Policy applies only to information collected by AG through the Website, Services, and App. The Website, Services, and App may contain links to, or integrations with, third-party websites and services that are not owned or controlled by us. Please be aware that we are not responsible for the privacy practices of any third-party website or service provider (including any AI provider). When you access a third-party website or enable a third-party integration, please review the privacy policies of that website or service provider, as they may collect your personal information independently of AG.

8. Information Security

We take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data. These may include appropriate encryption and physical security measures to guard against unauthorized access to systems where we store personal data. Although we implement reasonable administrative, physical and electronic security measures designed to protect your information from unauthorized access, we cannot ensure the security of any information you transmit to or guarantee that this information will not be accessed, disclosed, altered, or destroyed.

AG’s security measures apply solely to data held within AG’s own systems. We make no representations regarding the security practices of any third-party service provider (including any AI provider), and we are not responsible for unauthorized access to or disclosure of data within their systems.

We will make any legally required disclosures of any breach of the security, confidentiality, or integrity of your electronically stored personal data in accordance with applicable law. Notice will be provided via email, posting within your Account, or such other method as required or permitted by applicable law in your jurisdiction. Please note that our breach notification obligations extend solely to data held within AG’s own systems and do not cover breaches occurring within the systems of any third-party service provider (including any AI provider).

9. Your Rights About Your Personal Information

a) For California Residents

California consumers have the right to request access to, deletion of, and additional details about our information practices regarding their personal data, and to opt out of sales of personal data. We do not sell your personal data. Transmissions of your User Data and Your Content to third-party service providers (including any AI provider) at your direction through integrations you enable are not considered sales under the CCPA. Please note that deletion requests apply solely to data held within AG’s systems — requests for deletion of data held by a third-party service provider must be directed to that provider directly.

You may make any of the above requests no more than twice in a 12-month period by contacting us using the information in the “How to Contact Us” section below. We are required by law to verify your identity before fulfilling any request. We will not discriminate against you for exercising your rights under the CCPA.

b) For EU/EEA Residents

If you reside in the United Kingdom, EEA, or Switzerland, you have the following rights under GDPR with respect to your personal data held within AG’s systems. Where we transmit your data to a third-party service provider (including any AI provider) outside the EU/EEA through an integration you enable, we will do so in accordance with applicable data protection law, including through Standard Contractual Clauses where required. Rights with respect to data held by third-party service providers must be exercised directly with those providers.

• Access. Request information about and access to your personal data.
• Correct. Update or correct inaccuracies in your personal data.
• Delete. Request deletion of your personal data held within AG’s systems.
• Transfer. Request a machine-readable copy of your personal data.
• Restrict. Restrict processing of your personal data.
• Data portability. Request transfer of your personal data to another organization.
• Object. Object to processing based on our legitimate interests.
• Withdraw consent. Withdraw previously given consent at any time; note this does not affect data already transmitted to a third-party service provider prior to withdrawal.
• You also have the right to lodge a complaint with your local Data Protection Authority or to the Data Protection Authority where the alleged infringement took place.

10. Your Choices About Your Information

In all promotional emails, you will be given the opportunity to opt-out of receiving such messages in the future by clicking on the link at the bottom of the email that says “unsubscribe.” Please note, we reserve the right to send you services-related communications (e.g., account verification, payment confirmations, technical and security notices) for which you may not opt out.

11. Updating and Correcting Your Personal Information

You can review and amend the information you have provided us by signing on to your login account. Please note that AG can only update or correct data held within AG’s own systems. Any data transmitted to a third-party service provider (including any AI provider) through an integration must be corrected or updated directly with that provider.

12. Changes to This Privacy Policy

We may amend this Privacy Policy at any time by posting the amended terms on the Website and within your Account. For material changes — including changes affecting how your data is shared with third-party service providers — we will use commercially reasonable efforts to provide advance notice via email to the address associated with your Account at least 30 days prior to any material changes taking effect. Your continued use of the Website, Services, or App after the effective date of any amendment constitutes your acceptance of the updated Privacy Policy. Changes will be reflected in the updated Effective Date at the top of this policy.
